The Texas Supreme Court has made it almost impossible to bring a suit for damages against a pharmaceutical company. It has determined that if the FDA approves a drug there should be a defense of pre-emption. The United States Supreme Court is considering doing the same nation wide. Digitek (digoxin) is different because it was manufactured defectively and contained twice the dose approved by FDA. Victims of this drug still have a fighting chance for justice in the court system.
